Waste Collection Bromley Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Bromley provides waste collection and related services to domestic and commercial customers. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, company or organisation requesting waste collection or related services from Waste Collection Bromley.
Services means any waste collection, removal, transport, loading, unloading, sorting, or related services provided by Waste Collection Bromley.
Waste means any materials, items, goods, rubbish, debris or refuse presented by the Customer for collection as part of the Services, excluding any Prohibited Waste as defined below.
Prohibited Waste means any waste or materials that we are not legally permitted or not willing to collect, transport or dispose of, including but not limited to hazardous, clinical, medical, chemical or radioactive waste, asbestos, gas bottles, pressurised containers, explosives, firearms, ammunition, corrosive substances, oils, fuels and any other items that may pose health, safety or environmental risks.
Agreement means the contract between the Customer and Waste Collection Bromley for the provision of the Services, comprising these Terms and Conditions and any written or verbal confirmation of the booking.
2. Service Area and Scope of Services
Waste Collection Bromley provides waste collection and related services primarily within Bromley and surrounding areas. Acceptance of bookings is subject to availability and the suitability of the location for collection access and safe operation. We reserve the right to decline any booking that falls outside our normal service area or where access or conditions are unsuitable.
The Services may include one-off collections, regular waste removal, bulky item collection, garden waste clearance, and light commercial waste services, as agreed at the time of booking. The precise scope of the Services will be confirmed in your booking confirmation.
3. Booking Process
3.1 Booking Requests
Customers may request a booking by telephone or via our online enquiry channels where available. You will be asked to provide details including your name, contact information, collection address, description and estimated volume or weight of waste, type of waste, access details and preferred date and time for collection.
3.2 Quotes and Estimates
Based on the information you provide, we may give an indicative quote or estimate. All quotes are subject to confirmation once our operatives have inspected the waste on arrival. If the volume, type or difficulty of access is materially different from the information provided at booking, we may adjust the price accordingly or decline to proceed with the collection.
3.3 Confirmation of Booking
Your booking is not confirmed and no Agreement is formed until we have accepted your booking and provided confirmation verbally, by email, text message or booking reference. We reserve the right to refuse any booking at our discretion.
3.4 Time Slots and Attendance
Any time or date given for collection is an estimate only. While we will use reasonable efforts to attend within the agreed time window, circumstances such as traffic, weather, vehicle breakdown or previous jobs running over may cause delays. We will aim to inform you of significant delays where possible, but we shall not be liable for any loss arising from late arrival, provided we attend on the date of booking or a rescheduled date agreed with you.
4. Customer Responsibilities
4.1 Access and Parking
The Customer is responsible for providing safe, lawful and reasonable access to the collection location. Any necessary parking arrangements, permits or permissions must be organised and paid for by the Customer in advance. If suitable parking is unavailable or if our vehicle cannot reasonably and safely access the location, we may cancel or rearrange the collection and apply a call-out or cancellation charge.
4.2 Presentation of Waste
The Customer must ensure that all waste for collection is clearly identified and separated from items that are not to be removed. Waste should be reasonably accessible, so that our operatives can load it safely without risk of damage to property or undue manual handling risks. If waste is not ready or is mixed with items not designated for removal, we may decline to proceed or adjust the price to reflect the additional time and work required.
4.3 Safety and Conduct
The Customer must ensure that the collection site is safe and that there are no hazards that may endanger our staff, vehicles or equipment. You must not ask our operatives to undertake any activity that is unsafe, unlawful or outside the agreed scope of the Services.
5. Waste Types and Regulations
5.1 Prohibited Waste
We do not collect Prohibited Waste. If Prohibited Waste is presented for collection or discovered among the Waste, we may refuse to remove it, leave it on site, or, if already loaded, return it to the Customer. The Customer will be responsible for any additional costs, fines or charges arising from the presence of Prohibited Waste and for arranging lawful disposal by a suitably licensed provider.
5.2 Hazardous and Special Waste
Certain waste streams may be regulated as hazardous or special waste under UK waste regulations and may require separate arrangements, documentation or permits. Where we agree to collect such materials, you must provide full and accurate information about their nature and composition. Additional charges may apply for handling, transport and disposal of hazardous or special waste.
5.3 Duty of Care and Licensing
Waste Collection Bromley will operate in accordance with applicable UK waste legislation and will only transfer Waste to appropriately licensed or permitted facilities. We will maintain the necessary registrations for waste carriers and will handle and dispose of Waste in compliance with relevant regulations. The Customer acknowledges their own duty of care to ensure that waste is transferred to a legitimate carrier and consents to us fulfilling this role for the Waste we collect.
5.4 Ownership of Waste
Ownership of the Waste transfers to Waste Collection Bromley once it is loaded onto our vehicle. We may at our discretion reuse, recycle, recover or dispose of the Waste in any lawful manner. Items removed as Waste will not be returnable to the Customer unless otherwise agreed in writing.
6. Pricing and Payments
6.1 Pricing Basis
Service charges are generally based on the volume and type of Waste, the time required to load, the labour involved, access considerations and disposal costs. Any prices provided prior to inspection are indicative only and may be adjusted on site once we have assessed the Waste.
6.2 Payment Terms
Unless otherwise agreed in writing, payment is due on completion of the collection. For domestic Customers, payment is typically required immediately upon completion via cash, card or other accepted payment methods. For business Customers with credit facilities, payment terms will be as agreed in advance, usually within a specified number of days from the invoice date.
6.3 Late Payment
Where payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate permitted under UK law and to recover any reasonable costs incurred in pursuing payment. We may suspend or cancel further Services until outstanding amounts are settled in full.
6.4 Deposits and Minimum Charges
We may require a deposit or pre-authorisation payment at the time of booking, particularly for large or commercial jobs. A minimum charge may apply to any collection, regardless of the volume of Waste actually removed. Any such charges will be communicated to you before the booking is confirmed.
7. Cancellations, Rescheduling and No-Show
7.1 Customer Cancellations
The Customer may cancel a booking by contacting us directly. If you cancel with sufficient notice before the scheduled collection time, we may not apply any cancellation charge. If cancellation is made at short notice, we reserve the right to charge a reasonable cancellation fee to cover our costs, including travel, staff and administrative expenses.
7.2 Rescheduling
Where possible, we will accommodate requests to reschedule a collection to another date or time, subject to availability. If a booking is rescheduled at very short notice, we may treat it as a cancellation and apply a cancellation fee, followed by a new booking for the alternative time.
7.3 No Access or Customer Not Present
If we attend the agreed address at the scheduled time and are unable to gain access, or if the Customer or their representative is not present when required to grant access or confirm which items are to be removed, we may consider the booking as a failed collection. In such cases we may charge a call-out or cancellation fee, and any further visit may be treated as a separate booking.
7.4 Cancellations by Waste Collection Bromley
We may cancel or postpone a booking due to operational issues, adverse weather, safety concerns, vehicle problems, staff illness or other circumstances beyond our reasonable control. In this event, we will aim to notify you as soon as practicable and offer to reschedule the collection. We shall not be liable for any direct or indirect losses you may incur as a result of such cancellation or postponement.
8. Liability and Limitations
8.1 General Liability
Waste Collection Bromley will exercise reasonable care and skill in providing the Services. However, our liability for any loss or damage arising from or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by the Customer for the specific collection giving rise to the claim, except where such limitation is prohibited by law.
8.2 Exclusions
We shall not be liable for any indirect, consequential or economic loss, including but not limited to loss of profit, loss of business, loss of data or loss of opportunity, arising out of or in connection with the Services. We accept no responsibility for items that the Customer or their representative has incorrectly identified as Waste and instructed us to remove.
8.3 Property Damage
Our operatives will take reasonable care to avoid damage to property when carrying out the Services. The Customer must tell us about any fragile surfaces, hidden services, or vulnerable areas before we start work. We shall not be liable for minor cosmetic damage, fair wear and tear, or damage caused by pre-existing defects, poor condition of property or circumstances beyond our control. Any claim for damage must be notified to us in writing as soon as reasonably practicable and in any event within a reasonable period after completion of the collection.
8.4 Personal Injury and Death
Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under UK law.
9. Complaints and Dispute Resolution
If you are dissatisfied with any aspect of the Services, you should contact us promptly with details of your complaint. We will investigate and aim to resolve complaints in a fair and timely manner. Where a dispute cannot be resolved directly, both parties agree to consider mediation or other forms of alternative dispute resolution before commencing court proceedings, where appropriate.
10. Data Protection and Privacy
We collect and process personal data such as names, contact details and service information for the purpose of arranging and providing waste collection services, administering accounts and complying with legal obligations. We handle personal data in accordance with applicable UK data protection laws. By using our Services, you consent to such processing. You have rights in relation to your personal data, including the right to access and correct the information we hold about you, subject to legal limitations.
11. Force Majeure
We shall not be in breach of the Agreement or otherwise liable for any delay or failure in the performance of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. Such events may include, without limitation, extreme weather, fire, flood, accident, road closures, industrial disputes, epidemics, pandemics, acts of government or regulatory authorities, and failure of third-party systems or services.
12. Variations to these Terms
We may amend or update these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice or our business operations. The version in force at the time of your booking will govern that particular Agreement. We recommend that Customers review the current Terms and Conditions before making each new booking.
13. Assignment and Subcontracting
We may subcontract or assign some or all of our rights and obligations under the Agreement to suitable third parties, including other licensed waste carriers, without prior notice, provided that this does not adversely affect the Customer's rights. The Customer may not assign or transfer their rights or obligations under the Agreement without our prior written consent.
14. Severability
If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.
15. Entire Agreement
The Agreement constitutes the entire understanding between Waste Collection Bromley and the Customer in relation to the Services and supersedes all previous discussions, correspondence, negotiations, arrangements or understandings of any kind. The Customer acknowledges that they have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.
16. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the Services, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
